Terms & Conditions

1. Purpose and Limitations of Product

Custom earplugs supplied are intended for general noise reduction and comfort purposes only.

The patient acknowledges and agrees that:

These earplugs are not tested, certified, or rated to SLC80 standards; and

They are not intended for use as compliant hearing protection in occupational, industrial, or regulated environments where certified hearing protection is required.

No representation or warranty is made that the earplugs will provide a specific level of noise attenuation.

 

2. Fit and Performance Guarantee (6 Weeks)

The provider will take reasonable care to ensure an appropriate fit and function.

If the patient experiences:

Discomfort; or

Insufficient noise attenuation

the patient is entitled to one (1) remake at no additional cost, provided that:

The issue is reported within six (6) weeks of the original fitting date; and

The earplugs are returned for assessment.

Remakes requested outside this period may incur additional fees.

 

3. Manufacturer Fault Warranty (2 Years)

A free-of-charge remake may be offered within two (2) years of the original fitting date where the earplugs:

Become deformed; or

Exhibit material deterioration (including perishing),

provided that:

The defect is determined to be due to manufacturer fault; and

The earplugs have been used, stored, and maintained in accordance with the provided aftercare instructions.

All determinations of manufacturer fault are made at the sole discretion of the provider and/or manufacturer.

 

4. Exclusions and Limitations of Liability

This warranty and any remake entitlement do not apply where damage or issues arise from:

Misuse, neglect, or improper handling

Failure to follow aftercare or hygiene instructions

Exposure to excessive heat, chemicals, or unsuitable environments

Modification or alteration of the earplugs

Normal wear and tear

To the extent permitted by law, the provider excludes all liability for any loss, damage, or injury arising from the use or misuse of the earplugs.

 

5. Health Considerations

The patient acknowledges that:

Custom earplugs may alter the ear canal environment, including moisture and ventilation.

The use of earplugs does not guarantee the prevention of ear conditions, including but not limited to otitis externa (ear infections).

The patient agrees to:

Maintain appropriate ear hygiene; and

Seek professional advice if experiencing pain, irritation, discharge, or other adverse symptoms.

 

6. Patient Responsibilities

The patient agrees to:

Follow all care, cleaning, and storage instructions provided

Inspect earplugs regularly for signs of damage or deterioration

Discontinue use if discomfort or adverse symptoms occur and seek advice

Failure to comply with these responsibilities may void eligibility for remakes or warranty claims.

 

Patient Consent and Acknowledgment

I have read and understood the above Terms and Conditions.

I understand the intended use and limitations of the custom earplugs.

I acknowledge that the earplugs are not SLC80-rated and are not certified hearing protection.

I understand the remake policy (6 weeks) and manufacturer warranty (2 years).

I acknowledge that use of earplugs does not guarantee prevention of otitis externa or other ear conditions.

I agree to follow all care instructions and accept responsibility for proper use and maintenance.
